UPDATE: Vendors Pedaling "Live Goods" Are Finally Banned From San Francisco Market MAY 2011: Authorities did nothing as birds were routinely confined without water or shade, squashed upside down in closed bags, thrown to the ground form trucks, and crushed inside filing-drawer sized cages. Why? Because California Penal Code section 597.3 exempts "poultry." For over a year, Kinship Circle advocates contacted San Francisco District Attorney Kamala D. Harris, San Francisco's Commission of Animal Control and Welfare and Department of Animal Care and Control...along with the city's Department of Public Health and Farmers Market Community Advisory Board. They expressed utter dismay at the D.A.'s failure to prosecute merchants, even though California's cruelty statute contains other sections that appear to outlaw the conditions these animals endured. We urged the D.A. to prosecute violators and seek maximum penalties under the law. We also stressed violation of California Food and Agriculture Code. Section 26602, which requires those transporting poultry to bring proper records or face arrest without warrant. Shouldn't this Code apply to consumers who move live birds on public transit or inside car trunks for use in slaughter, religious sacrifice, or animal fighting? We called upon the Department of Public Health to investigate live markets because animals are ferried into restaurants, buses, rapid transit trains, and shared dwellings, often kept alive to be "fresh-killed" prior to meal preparation. Why hadn't regulators enforced San Francisco's Health Code 050: "No live bird or fowl shall be kept or allowed in a food facility."Lastly, we reminded market managers about the potential for personal liability cases involving vendors who conduct illegal activities. The Heart of the City Farmers’ Market officially declared a ban on live bird sales, effective 5/27/11. Raymond Young Poultry and Bullfeathers Quail are now prohibited from retailing animals at the Wed/Sun market in San Francisco’s UN Plaza.
